Did The EU Accidentally Support A '3 Strikes' Policy For Internet Users?

Posted Wednesday July 9, 2008, 2:35 pm, Over one day old
There was talk earlier this week that, despite an earlier rejection in the EU of a "three strikes" plan that would effectively turn ISPs into copyright cops, a new vote might backdoor in the same results. To many, that sounds like turning the ISPs into copyright cops.

Too Much Ownership Can Be Bad For The Economy

Posted Wednesday July 9, 2008, 2:35 pm, Over one day old
Property rights don't make much sense when a resource isn't scarce, because there need not be any question of how to best allocate it, since anyone who wants it can have it. In those cases, adding property rights actually makes the market less efficient by limiting the allocation.

How Do You Prove You Were Warrantlessly Wiretapped If It's A Secret?

Posted Wednesday July 9, 2008, 2:35 pm, Over one day old
It's a bit convoluted when you think about it: there's no way to determine if illegal spying took place because the only way you could get the evidence would be to first prove you have the evidence that it took place.

Blaming The Flickr API For Copyright Infringement?

Posted Wednesday July 9, 2008, 2:35 pm, Over one day old
I have no problem with using this functionality for all uses other than the unauthorized publication of my work. And not by requiring Goldstein to mark his photos "friends only," mind you -- Goldstein doesn't want to lose the promotional value of Flickr's tag searches and RSS feeds.

Jim Prentice Wishes People Wouldn't Be So Specific In Their Questions Over Canadian Copyright Law

Posted Wednesday July 9, 2008, 2:35 pm, Over one day old

California Can't Resist: Wants To Tax iTunes Downloads Again

Posted Tuesday July 8, 2008, 8:14 pm, Over one day old
There are some states that already include a sales tax on internet downloads for things like iTunes purchases (even if the rationale for the tax doesn't seem to exist beyond "the state needs money"). Every so often various other state politicians start itching to add an iTunes download tax.

Once Again: Do Not Send Legal Threats To Companies Because You Don't Like What A User Says

Posted Tuesday July 8, 2008, 7:04 pm, Over one day old
When 800Notes told the owner of mynutritionstore that it would not remove the negative reviews, he apparently threatened to sue 800Notes. So, once again, just because you dislike what someone has to say about you online, it doesn't mean that it's illegal.

Mixed Ruling In Case Over Limitations On DMCA Anti-Circumvention Clause

Posted Tuesday July 8, 2008, 3:41 pm, Over one day old
The ruling dismisses some of Coupons.com's claims, while allows others to go forward. However, on the issue of whether or not just explaining how to circumvent the copy protection by deleting some files is a DMCA violation, the court is allowing that issue to move forward at trial.

Google's Lively Seems Lifeless; Joins A Big List Of 3D Chat Providers

Posted Tuesday July 8, 2008, 2:34 pm, Over one day old
It's still not clear what the actual advantage of such an offering is beyond traditional chat -- or what sort of advantage Google may have in providing a similar solution to what's already out there, beyond just the Google brand name. It's not clear that Lively really does any of that.

Will Google Cultivate Its Virtual Worlds To Make Them Lively? Definitely

Posted Tuesday July 8, 2008, 2:34 pm, Over one day old
We're running a little experiment here with our discussion on Google's new Lively offering. Additionally, Google can build upon Gmail and Google Maps and its other offerings to enhance Lively -- which is something that Second Life and other virtual worlds can't necessarily do.
